    Default Stuck, between a rock and a hard place

    I know a lot of you have gone out and done your own, started your business and etc... for me I get that itch... I get tired of seeing my paycheck go to somebody else. I am making money for somebody else.

    But, I have this damn none compete.

    Its a rock and a hard place.

    You should talk to a lawyer, a lot of non-competes are very difficult to enforce, depending on the state.

    ^ x2. Depends on States, and it also depends on your business. A federal law says that no state shall remove anyone's right to provide for their family. Some states will not recognize a non-compete agreement even it was signed by both parties, you see this a lot in Texas where the employee's company is based out of another states and not familiar with Texas law and want you to sign anyway.

    Other states will only uphold you to "taking of existing clients"

    so are you saying that working for yourself is always greener?

    In the State of Oregon none competes do hold up. I need to check in with a lawyer and really have them look at it. When I read mine its like a brick house.

    Basically when the owners of my company left where they were all working, they found a loophole in their none compete, so with the none compete that I signed is rock solid. To boot it says 3 years...

    it can't be enforced after you quit - impossible - unless there's a payout of some sort when you quit.

    Both sides of the fence have their pros and cons. One side isn't better or worse, but I'd have to say from experience, doing your own thing comes with a lot more work, more stress and not necessarily more money. The advantage is freedom and the ability to choose your own path. I'm sitting on the other side from you and sometimes a good paycheck/steady hours/benefits looks very compelling.

    I will never tell anyone to not jump out of the regular job world and into the business world, but I'd suggest being as informed as possible before you did so.
