Taking car to be serviced for same issue that I took it in for 3 weeks ago..
California Lemon Law states that after a "reasonable amount of attempts" the dealer, and manufacturer are bound by law to either replace the vehicle, or refund you your money, with the exception of mileage used..
I talked to my mother who is an expert with this stuff because for some reason everything seems to break with her, and she said the magic number is 3. KrackerXL also had a similar issue 2 years ago with his 135, but multiple issues, not just one problem. He says after the 3rd time to contact corporate.
As much as i have loved driving this car, i never had issues like this with my Honda(first car, handed to me by my dad with 200,000+ miles on it) and my scion(bought it used with 100k miles). I still want a new car so i think i might go with a brand new Veloster, or the new Scion FRS.. cheaper toy to play with, and i can have it fully loaded at nearly half the cost..
What do you guys think.. Not sure about California but in Florida your car has to be in service for 30+ days for the Lemon law to apply.

The car idles extremely weird sometimes. Hard enough at times that it shakes pretty rough.. The first time it happened I thought it was an earthquake.
Sherdog, I looked up up on the CA DMV website, unfortunately for you guys it probably is 30 days, here, it's only a reasonable amount of attempts, which to me, for being how new the car is.. If they can fix an issue by the 3rd time, the car is faulty! Sounds like spark plugs and ignition coils. Which shouldn't be bad in a new car lol. Could also be considered camshaft positioning sensor which are all common failures for BMWs. But not until after 60k miles. I mean I've seen this same idle issue plenty of times with BMWs that have 80k miles or more. It's always either ignition coil or spark plugs. Rarely though it'll be the vanos which normally just needs new seals.

Lemon Lawing a car neither easy or fast
At least not here in NY
Had multiple repeat issues with my e46 m3 years ago.
In end, BMW ate 6 months lease payments and kept car the better part of a month having some senior tech go through the car.
Was good to go after that..-Kurt

Maybe you should contact your attorney and ask them to see just where you stand on this.

so this time they said it was a firmware issue.. im thinking wtf? how does my car leave the lot with bad firmware? seriously?
whatever the problem may be, next issue(third time) they'll have to either replace the vehicle, or give me the money back.
ca lemon law is very clear, and i know a few people that have dealt with it quite briskly.
in other news, my dad will probably be taking over the car since i'm pissed as it is, and have been looking at the Scion FR-S. He wants a nice car, and since he doesnt drive much, he'll put a lot less miles on it daily that i will. I know what you are all thinking... beamer to a scion
... but im doing a bit of a lifestyle change and im in the middle of moving and trying to save a bit more money monthly so i can get a home by 25-26 years old. Plus the scion will have endless modifications, at a better price im sure. Can't wait!
