If you don't mind buying something with ~35xxx miles you may be able to sneak into a B8 S4 (if power is desired)

I've been borrowing a friends 2007 650i convertible for a few weeks on and off. They can be had for 30-40k and still be in good conidition. It's an awesome car for daily driving. If I was in your situation, I'd be all over a used 650i bmw.
I'm all for an M5, but I'm not sure about getting one for 40k.. I mean, if you can find one for 40 that doesnt have any problems, then great. I just think the 650 is a better package for the money since you'd be buying used anyway.

Yeah, my boy has had one for a year (2008)...he LOVES it, but tune ups, oil changes, etc. are killers. And if you keep it in M-Mode, the gas mileage is a beast...but that depends on you I guess ;-) hahaha. I'm no M5 expert, but he also tells me that you want to stick with 2008 or newer for "bug" issues, which may keep you north of $40k :-/
